Equine Savior’s Stallion Service
Auction offers donated stallion
services to the public in an
auction, with proceeds being donated
to Equine Savior Corporation, a
501(c)(3) charitable organization.
Equine Savior would like to thank
all the stallion owners for their
generosity.

for the Stallion owner
Stallion
owners will receive a charitable
receipt for the regular stud fee.
Other advantages are free
advertising on the Equine Savior
Website, and other promotional
advertising we do for this
fundraiser. In addition,
www.AnimalAdvertisements.com is
offering free advertising for one
year.
Benefits
for the Mare owner
For the mare owners,
the advantages are the support of a
charitable organization and the
possibility of a bargain stud fee.
The cost of mare care, vet expenses
and the shipping of semen are, as in
all breeding contracts, the
responsibility of the mare owner.

Your participation will help to
support Equine Savior in its mission
to rescue and rehabilitate horses
that have been have been saved from
slaughterhouses, or from abuse and
neglect.

TERMS
& CONDITIONS
Stallion
owners will need to complete an
application and donation agreement.

After providing Equine Savior with
the following information and
completion of the forms, an Equine
Staff Member will upload the
information into the auction
program.

The stallion owner will provide
the following details to Equine
Savior to post online for the
bidder’s review:
a)
Stallion lineage
b)
Photograph
c)
Accomplishments (optional)
d)
Any special requirements for bids to
be accepted e.g. purebreds only.
e)
Statement of what additional fees
are/are not included in the stud
fee: any board, vet fees, handling
fees, etc.
f)
Statement of what types of breeding
services are available: live cover/A.I
only, frozen, cooled or chilled
semen etc.
g)
Statement of any foal guarantees.
h)
Supply Equine Savior with a sample
of your stallion service contract
for your stallion that lists your
terms – if one is available.
i)
It is the Stallion owners
responsibility to check their
stallions details on the Equine
Savior website to verify that the
details are correct.

The minimum bid on a stallion
shall be half the regular stud
fee, which will be shown in US
dollars.
-
Stallion owners receive a
charitable receipt for the full
amount of their stud fee; they
will also be notified of the
actual winning bid amount.
Stallion owners must consult
with their own tax advisors as
to which amount is tax
deductible. Equine Savior does
not provide tax advice or
guarantees.

Winning bidders will be making a
donation purchase of a stud fee,
which are generally not tax
deductible.

Minimum bidding increments will
be $50.
-
Auction dates (open/close) will
be determined solely by Equine
Savior.
-
All bidding must be done through
the website auction program. We
will not accept bids via email,
phone, or direct mail.
-
The winning bid will be
determined by the auction
program. You will be notified
via the email you input into the
program. Equine Savior will also
be notified there is a winner.
You will have 72 hours from the
time the bidding closes to
respond, and ten days to submit
payment.

If there is no response within
72 hours, or payment received
within ten days from the time
bidding closes, the bid will
revert to the next highest
bidder, if there is one. If
there is not one, Equine Savior
reserves the right to not accept
the winning bid.

Stallion owners will be informed
when payment on their stallion
has been received in full. They
will not breed the winning mare
or ship semen until Equine
Savior has notified them to this
effect.
-
Money collected by Equine Savior
for breeding sold through the
auction will be used at the
discretion of the officers, for
continued service improvement to
the membership or other uses
that would benefit the
membership.
-
The breeding must be initiated
in the current breeding season,
unless prior arrangement is made
with the stallion owner. Winning
bids may not be banked for
future years breeding.

The winning bidder agrees to pay
to the stallion owner all other
expenses associated with
breeding the mare, such as
booking fees, per day mare care,
shipped semen and/or any
associated reproductive and
veterinary expenses etc. If
there are any questions
regarding these fees, it is the
responsibility of the bidder to
contact the stallion owner/agent
before placing a bid.

The winning bidder agrees to
abide by the terms of the
stallion owners contract for
that stallion.

The winning bidder agrees and
acknowledges that he/she fully
realizes that there is a
possible danger of injury or
death in the breeding of horses
and the attendant care of the
mare. The winning bidder
voluntarily assumes all risks of
accident, injury or death to
said mare and specifically
releases Equine Savior, it’s
officers, employees, and agents
from all liability for any and
all injury or disability
suffered by or sickness or death
of the mare or foal from any
cause whatsoever, and
specifically waives any and all
claims resulting from such
injury, disability, illness or
death.

The winning bidder specifically
acknowledges and understands
that Equine Savior makes no
warranties either expressed,
implied or by any other means of
interpretation in connection
with this agreement. IT IS
EXPRESSLY UNDERSTOOD BY THE
WINNING BIDDER THAT EQUINE
SAVIOR IS ACTING AS NOTHING MORE
THAN A SELLING AGENT OF THE
STALLION SERVICE, AND THE
STALLION OWNER IN TURN HAS
AGREED TO DONATE THE PURCHASE
PRICE OF THE STALLION SERVICE
FEE TO EQUINE SAVIOR AS A
FUNDRAISER.

The winning bidder will be
obligated to Equine Savior for
the winning bid whether or not
the mare owner uses the bid.

This stallion service auction is
run as a fundraiser for Equine
Savior, which is an IRS,
approved 501(c)(3) charitable
organization. As such, Equine
Savior will NOT provide a refund
to the mare owner under any
circumstances.

By submitting a bid in any way,
bidders certify that they have
read, understood and agreed to
the Terms and Conditions
relating to this auction.

You hereby release and hold
harmless the Equine Savior
Corporation, its respective
subsidiaries, affiliates,
directors, officers, employees,
attorneys, agents and
representatives from any and all
liability for any injuries,
loss, claim, action, demand or
damage of any kind rising from
or in connection with this
auction page, or any alien sites
attached to this page.

You hereby agree that any and
all disputes that cannot be
resolved, and causes of action
arising out of or connected with
Equine Savior Corporation, shall
be resolved individually, or in
arbitration, without resort to
any form of court action, before
a court of competent
jurisdiction located in Clark
County, Nevada, which court
shall apply the laws of the
commonwealth of Nevada, without
regard for rules of conflicts of
law. In any such dispute,
participant shall, under no
circumstances, be entitled to
claim punitive, incidental or
consequential damages, or any
other damages, including
attorneys' fees, other than your
actual out-of-pocket expenses
(if any) associated with
participation of this auction
page. Furthermore, you hereby
waive all rights to have damages
multiplied or increased.
Privacy
Statement
Equine Savior Corporation collects
certain personal information such as
your name and address. This is used
solely to fulfill your order and
will be stored in compliance with
the requirements of the Data
Protection Act. We will respect all
customer requests regarding the use
of their personal data. Please let
us know by email to
Administration if we are
deficient in any way in this
respect. We do not sell or trade any
of your personal details to third
parties. If at any time you want to
know what information Equine Savior
holds about you feel free to contact
us and we will provide you with all
the data. If you want information
removed, please let us know at any
time.
Equine Savior reserves the right to
use your mail, or email address for
our newsletter. If you receive our
newsletter, and do not wish to
receive it again, please make sure
you use the opt-out feature within
the newsletter program.
